Below is a sample of the contract that is used for purchasing CommPay Software on a time payment plan.

Contract Enactment: The User understands and agrees that the initial payment, as described in the Payment Agreement Terms, to CommPay Software by The User for the licensed use of CommPay Software (hereinafter known as Software) enacts this contract and that the initial payment also voids any and all warranties (other than the warranties described in the Software License And Limited Warranty) issued by CommPay Software for the use of the Software, stated or otherwise implied. The User understands and agrees that this contract does not add to, subtract from, or in any way alter the warranty for the Software as stated in the Software License And Limited Warranty.
 
Time Payment Agreement: The User understands and agrees that this contract constitutes a time-payment agreement that spreads the purchase price of the Software over ___ payments and that this time-payment agreement is irrevocable and unchangeable. The User understands that the outright purchase price of the Software in a single payment is not the same as the time-payment purchase price of the Software. Upon receipt of the initial payment for the Software by CommPay Software from The User this contract is enacted and each remaining payment must be paid in full on the date due. This contract can not be prepaid for a discount. If the sum of the remaining payments, as indicated in the Payment Agreement Terms, is paid in full by The User prior to due date of the last payment the terms of this contract will be considered met in full
 
The User understands that this purchase is final and irrevocable and any and all payments received from the user by CommPay Software are non-refundable under any circumstances.
 
The User understands and agrees that this contract covers and includes only the Software options installed in the Software package initial purchase at the date of enactment of this contract and does not include any options or additions to the Software made after the enactment of this contract. This sale contract is for the Software and options installed per sales invoice number ______________
 
Support and Upgrades: The purchase price of the Software includes unlimited technical support as necessary for a period of one (1) year following the date of purchase. The purchase price of the Software also includes all Software upgrades that are released during the one (1) year period following the date of purchase. After the one (1) year period following the date of purchase has passed unlimited technical support and unlimited access to released upgrades is available for an annual rate that is determined by the installed options. The Software will continue to function indefinitely as is after the initial one (1) year period if The User chooses not to pay the annual support and upgrade fee.
 
Payment Agreement Terms: The initial payment in the amount of _______________ will be paid on or before the date of ________________________. This date constitutes the date of enactment of this contract. The remaining _______ payments in the amount of  _____________ each will be due on the  ___________ day of each month starting 30 (30) days from the date of contract enactment. The User has the option of sending the scheduled payment to CommPay Software so that each payment will be received by CommPay Software on or prior to the due date or to provide to CommPay Software a credit card number for automatic payment. The User will not be billed by CommPay Software and is responsible for making scheduled payments without request by or from CommPay Software. If automatic credit card payment is arranged The User understands and agrees that CommPay Software will automatically charge to The User’s credit card on the day that each payment is due the amount of the payment.
 
Registration Number: Upon receipt of payment from The User CommPay Software will give The User, either by phone or email, a registration number to be entered into the Software that will enable continued use of the Software until the next payment due date. The registration number will be given to The User in a sufficient amount of time to prevent shutdown of the Software. Monthly registration numbers will not be required to be entered into the Software after the last scheduled payment is received and the final registration number is given.
 
Default: The User understands that if a scheduled payment is not received by CommPay Software on or before the due date The User will be in default of this contract and The User will not be given a registration number for the continued use of the Software and that the Software will cease to function. The User understands and agrees that default does not release The User from the terms of this contract and that default will result in all remaining payments becoming due upon the date of default. The date of default will be considered to be the day following the date of the unreceived scheduled payment. The User agrees to pay any and all costs incurred by CommPay Software in the collection of amounts due from a contract default.
 
The User agrees to hold CommPay Software employees of, and shareholders harmless and exempt from any and all business loss as a result of the Software ceasing to function because of default by The User and subsequent withholding of the monthly registration number by CommPay Software. Furthermore, CommPay Software, employees of, and shareholders shall not be liable for any direct, indirect, consequential or incidental damages (including damages for loss of business profits, business interruption, loss of business information, and the like) arising out of the use or inability to use the Software.
 
I understand and agree to the terms of this contract as stated on this page and page one and pre-authorize the automatic billing to my credit card the above stated monthly payment.
